Terms & Conditions of Rental

These T&C define the conditions of short-term recreational rental of Villa Oesterdam 241 (hereinafter "the Villa"), as well as the mutual obligations of MA2X BV (hereinafter "the Lessor") and the tenant (hereinafter "the Client").

• 2.1 Reservations are made via the online form on villaonthewater.immo, oesterdam241.be or oesterdam241.nl, or by email to info@villaonthewater.immo.
• 2.2 The Client must be at least 21 years old to make a reservation.
• 2.3 The Villa is intended for family recreational use. Non-family groups (bachelor/bachelorette parties, student events, club outings or similar) are not accepted.
• 2.4 The reservation becomes firm upon receipt of written confirmation from MA2X BV and payment of the deposit.
• 2.5 In accordance with Article VI.53 of the Belgian Code of Economic Law and the short-term nature of the rental contract, the 14-day right of withdrawal does not apply.

• 3.1 Rates are stated in euros (€) and include the applicable VAT.
• 3.2 Rates include: made beds, towels, kitchen equipment, final cleaning, WiFi.
• 3.3 Rates do not include: the local tourist tax (toeristenbelasting), payable directly at the resort reception on arrival; the security deposit; modification fees (€30 per accepted modification); any surcharges for additional services.

• 4.1 A deposit of 25% of the total amount is due upon booking.
• 4.2 The balance must be received by MA2X BV no later than 14 days before the arrival date.
• 4.3 For any reservation made less than 14 days before arrival, 100% of the amount is due immediately.
• 4.4 Any late payment may lead MA2X BV to terminate the reservation and apply the cancellation schedule set out in Article 6.

• 5.1 A security deposit of €1,000 is due on arrival, by bank card or transfer.
• 5.2 The security deposit is intended to cover any damage to the Villa or its inventory, or any other costs attributable to the Client (abnormal cleaning, loss of keys, etc.).
• 5.3 The deposit, or its balance after deduction of any costs, is refunded within 14 days after departure.
• 5.4 If damages exceed the amount of the deposit, the Client remains liable for the difference.

6.1 Any cancellation by the Client must be notified in writing to info@villaonthewater.immo.

6.2 Cancellation fees are calculated according to the following schedule, based on the total stay amount:

6.3 In case of no-show within 24 hours of the scheduled arrival date without prior notice, the reservation is deemed cancelled and 100% of the total amount remains due.

6.4 The Client is advised to take out cancellation insurance with their insurer or via a specialised platform.

• 7.1 The Villa is available from 15:00 on the arrival day.
• 7.2 The Villa must be vacated before 10:00 on the departure day.
• 7.3 A valid identity document may be requested on arrival.
• 7.4 Early departure does not entitle the Client to any partial or full refund.

• 8.1 The Villa accommodates a maximum of 8 people (babies included). Any excess leads to immediate termination of the contract without refund.
• 8.2 The Villa is strictly non-smoking, including the covered terrace.
• 8.3 Pets are not allowed.
• 8.4 Parties, noisy gatherings and any event disturbing the tranquillity of the resort are prohibited. The Client undertakes to comply with the internal regulations of the Waterrijk Oesterdam resort.
• 8.5 The Client is responsible for the proper upkeep of the Villa and for any damage caused during the stay.
• 8.6 The Villa must be returned in a clean state (dishes done, rubbish placed in the resort's designated containers).

The tourist tax (toeristenbelasting) set by the municipality of Tholen is payable by the Client. Its amount varies according to the rates in force in the municipality and is payable directly at the reception of the Waterrijk Oesterdam resort upon arrival.

• 10.1 MA2X BV declines all liability for theft, loss or damage to the Client's belongings, except in the case of gross or intentional fault by MA2X BV.
• 10.2 MA2X BV is not liable for temporary disturbances related to the resort (works, exceptional service closures) which are beyond its control.
• 10.3 The Client is invited to take out holiday insurance covering their civil liability and their belongings.

In the event of force majeure (natural disaster, fire, armed conflict, pandemic or any other cause beyond the control of MA2X BV), MA2X BV reserves the right to propose a new date or to refund the Client. No additional compensation may be claimed.

The data collected as part of the reservation are processed in accordance with our Privacy Policy, in compliance with the General Data Protection Regulation (GDPR).

• 13.1 These T&C are governed by Dutch law, in accordance with the location of the Villa.
• 13.2 In the event of a dispute, and after an attempt at amicable resolution, the Client may refer the matter to the Recreation Disputes Committee (Geschillencommissie Recreatie, The Hague, Netherlands) or to the competent Dutch courts.

MA2X BV reserves the right to modify these T&C at any time. The applicable T&C are those in force on the date of the reservation. The most recent version is available at any time on the website.
